DESCRIPTION:
This session will cover the current Codes of Practice, in particular the most recent additions introduced in 2015 to include:
· Necessity Test;
· Transgender;
· TPIM Notices;
· EU Directive 2010/64;
· Identification Issues.
Recent PACE case law and future potential changes to the Codes of Practice will also be discussed.
The seminar will also focus on the area of Children and PACE and how children are dealt with following the structure of the Police and Criminal Evidence (NI) Order 1989. This section will identify issues of direct relevance of interest to children and discuss areas including:
· Stop and Search;
· Entry, Search and Seizure;
· Arrest;
· Detention;
· Questioning and Treatment;
· Youth Engagement Clinics.
This session will be of particular benefit to practitioners attending police stations and youth courts. The seminar will be supported by a range of useful resources provided on a memory stick. This will include all versions of PACE Codes of Practice, information on the Appropriate Adult Scheme and Youth Engagement Clinics as well as a significant database of criminal case law compiled by the presenter – Seamus McIlroy – Director of Legal Services, Office of the Police Ombudsman for Northern Ireland.
