Multi Unit Developments

Practitioners have brought concerns for their clients who dwell in multi unit developments to the Society’s attention on numerous occasions. Issues relating to the maintenance of communal areas, unexplained increases in service charges and inadequate provision for structural repairs can often arise in multi unit developments. The Society is concerned that the law as it stands does not provide adequate protection to multi unit development dwellers and has highlighted this issue on a number of occasions.

The Society has responded to a consultation carried out by Mr Kieran McCarthy MLA relating to a proposed private members bill introducing a right for multi unit development owners to remove and replace the management company responsible for the maintenance of the communal areas in their development. In its response the Society highlighted the need for a more holistic reform of the law relating to multi unit development dwellers’ rights and invited Mr McCarthy to discuss the issue, as the Society had, with the NI Law Commission.

The Society understands that Multi Unit Developments will now form part of the NI Law Commission’s first programme of work.
