A Friendly Divorce

Imagine a scenario where two family solicitors representing a husband and a wife agree not to go to court but rather to pursue together a negotiating style that gives the husband and wife a responsibility for their own divorce.

Collaborative practice is considered appropriate for the following issues :-

  • Decisions about separation and divorce
  • housing and property arrangements
  • residence and contact arrangements
  • financial support.

Each client needs to apport a qualified collaborative solicitor for the purpose of advising, negotiating and assisting in problem solving.

A valuable feature of the process is its ability to allow clients, where appropriate, to benefit on a joint basis from the participation of other professionals such as an independent financial advisor or accountant, a counsellor or child development specialist.
