Continuing Professional Development (CPD)

The Solicitors Training (Continuing Professional Development) Regulations 2004 came into operation on 6th January 2005. The Regulations apply to all solicitors on the Law Society's roll of solicitors who hold a practising certificate. The Regulations replace the previous CPD scheme which had applied only to solicitors admitted to the roll on or after 6th January 2002.

Whether you are primarily involved in criminal or civil work, this course will enable you to improve and develop your advocacy skills, get an insight into those factors that make a competent advocate and hopefully enhance the esteem in which solicitor advocates are held by the Judiciary and public at large.

A Certificate in Advanced Advocacy will be awarded on successful completion of the course.

Since then we have seen many changes to those rights, including the protection of those called to jury service. We review the statutory rights to time off work in their entirety.2007 saw the start of some huge and important changes to the law relating to time off from the workplace. The 'family-friendly' rights changed from April and there were new rules and regulations relation to maternity, paternity and adoptive rights. These look set to change further, with extensions to maternity pay and paternity leave announced.We saw one increase in holiday entitlement in October 2007, with more to come in 2009. This event will consider the impact of such changes together with relevant case law on absence.

Corporate Manslaughter

The Corporate Manslaughter and Corporate Homicide Act 2007 comes into force on 6 April 2008 and introduces a new statutory offence of corporate manslaughter in England, Wales and Northern Ireland. This means that an organisation whose gross negligence leads to death will face criminal prosecution for manslaughter. Organisations covered by the Act, including corporations, partnerships and trade unions will be guilty of the new offence if the way their senior management (individually or collectively) organises or manages their activities causes a person's death and this amounts to a gross breach of a relevant duty of care owed to the deceased. This seminar will examine the implications of the new legislation and how this differs from the present position. We shall look at the role of the Health and Safety Executive in Northern Ireland and what advice should be offered to clients in preparation for their new responsibilities e.g. safety management documentation.

Beverley Jones will then look at issues arising in equal pay claims which will include particular reference to the management of claims involving multiple claimants. The vast majority of people dealing with a solicitor do so in an efficient and satisfactory way. However, occasionally, due to the highly complex nature of these dealings problems can arise. When this happens it is important that solicitors know how to deal with the issue quickly and effectively.
The Society has long recognised the need for all legal firms to have sound client relations practices - indeed many firms currently have strong policies in place. In his recent Review of Legal Services, Sir George Bain stated that he saw a need for change in how client complaints were handled and wrote that "all solicitors firms should have a formal complaints procedure in place that is made known to all clients and prospective clients."
In furtherance of this aim the Society proposes implementing new regulations to be known as the Solicitors (Client Communication) Practice Regulations 2008 which provide that clients must receive a Terms of Engagement letter indicating the nature of the work being carried out, who will be doing it, how much it will cost or how fees will be calculated and that each firm will have an in-house complaints procedure.
The regulations will undoubtedly have an impact and short-term adjustment will be needed, however the long-term benefits of this will be early resolution of complaints, preservation of client-solicitor relationships and a decrease in the number of complaints to the Society thus benefiting the profession as a whole.
The regulations will come into effect on 1st September 2008 therefore the Society is undertaking a series of CPD events to communicate with the profession and present and explain the new regulations before they come into force. A substantial and comprehensive resource pack will be made available on the day. This is without doubt a vital seminar to be involved in as the changes will affect every solicitor.

Alleviating Burdens on Land: Case Law Insights on Litigation v Title Indemnity - Using Title Insurance in the 21st Century

Since its introduction into the UK conveyancing market in the 1980's, title insurance has predominantly been regarded as the solicitor's last resort, only to be relied on once all other risk deletion avenues are exhausted. However, the UK wide property boom of recent decades and the more topical influx of property investors and developers in the Northern Irish market, has resulted in greater demand for title insurance as a risk management device. As transactions become increasingly complex and as demanding clients impose stricter time constraints on solicitors, the utility of the product has never been more apparent.
This seminar proposes to examine, using case studies and recent UK judgments, the basic principles associated with the use of title insurance for risk management and as a mechanism for enabling solicitors to work smarter in the interests of their clients. The following topics will be covered:
1.The mechanics of the standard title insurance policy with emphasis on:

  • Indemnity limits and loss definitions -the range of cover available -claims handling
  • Basic insurance principles as they relate to these specialist insurance policies.
2. The case for insuring risks as opposed to deleting risks with reference to the following more frequently encountered risks:
  • Restrictive covenants
  • Adverse possession / possessory title
  • Ransom strips
3. The utility of title insurance in the following complex deal categories:
  • Property investment portfolios
  • Development sites
  • Property asset backed securitisations
